WHAT IS MEDIATION?
Mediation is a process that follows an established yet flexible path toward the resolution of a dispute without the use of a third party decision maker, such as a judge or jury. A successful mediation results in the termination of litigation following a mutual agreement that leaves all parties equally satisfied and dissatisfied with the end result.
DOES THE MEDIATOR MATTER?
Of course the mediator matters! The mediator you choose could very well determine whether the case is resolved successfully or not. In most cases, you will have only one clear shot at mediating your case. No one wants to waste their time, their money and their emotional capital in a process that leads nowhere. Getting to YES requires skill and experience. Choose your mediator wisely.
